Man is accused of trying to have sex with a teenager near Miami Gardens Park

MIAMI GARDENS, Florida — A 32-year-old man was arrested Sunday after police said he tried to have sex with a 14-year-old girl near a park in Miami Gardens.

Miami Gardens police officers said they responded to a local police station shortly before 10 a.m. that same day for a sexual assault incident.

Upon arrival, police said they spoke with the victim, who said she first met Devontre Biggins on Sept. 20 in an open parking lot in Miami Gardens.

The victim told investigators that Biggins knew she was only 14 years old, but said he continued to communicate with her on social media after they exchanged account information, the report said. Authorities also confirmed that the specific platform he used was not disclosed in his arrest report.

The victim said Biggins was “willing to pay her $50 for sex,” police wrote.

The victim told investigators that she refused to pay every time Biggins brought up a conversation about sex.

Police said Sunday that the victim said she agreed to meet Biggins at a local park and got into his SUV, where he immediately unzipped his pants, showed her his penis and asked the victim to perform oral sex , to which she said “No.” and also refused his request to have sex with her.

The victim told police she tried to get out of the SUV, but claimed Biggins grabbed her by her hoodie and said, “You're not leaving, and I know where you're staying.” However, investigators said she broke free and was able to run to a nearby residence for help, where police were called.

According to the report, Biggins briefly followed her before entering the apartment. Based on the victim's description, officers located him at a nearby complex, where they said he was taken into custody.

After being read his Miranda rights, police said Biggins told them he never intended to have sex with the victim, but just “wanted to be her friend.”

Jail records show that he faces one count each of leud and lascivious presentation of a child under 16, seduction or enticement of a child to engage in sexual conduct, and one count of deprivation of liberty.

Biggins remains at the Turner Guilford Knight Correctional Center, where his bond was listed as “to be determined” as of Monday afternoon.
