Charges have been dropped against a Clark Atlanta student accused of a road rage shooting

All charges have been dropped against a Clark Atlanta University student accused of pulling the trigger in a road rage incident.

Ladavious McNair, 32, has been in custody since his arrest at the Fulton County Jail on charges of aggravated assault, aggravated assault and possession of a firearm during the commission of a felony.

According to an affidavit, the incident occurred in November 2023 near the intersection of Metropolitan Parkway and Ralph David Abernathy Boulevard following an accident. The victim claims a person, who police later identified as McNair, pistol-whipped him before shooting him in the knee and speeding away.

But since his arrest, McNair has maintained his innocence. His lawyer said there was no way he could have committed the shooting because he was in class working on his doctoral dissertation.

McNair's classmates and fraternity brothers also expressed concerns about the case.

“The profile doesn't fit the crime, but they didn't even want to hear it,” McNair's fraternity brother Kenneth Love told FOX 5 in October.

Atlanta police say the flock camera system captured McNair's car in the area around the time of the incident. Those close to McNair say it was because he was on his way to class.

“How can we equate this type of behavior with a road rage incident against a gentleman who was in class at the time and pursuing his PhD? It just doesn’t match the math,” Love said

At a hearing at the Fulton County Courthouse on Friday, a judge sided with McNair and called the case against him “outrageous.”

After dismissing the case, the judge said the Fulton County District Attorney's Office should apologize for the way it handled the case.

McNair's attorney says he is expected to hopefully be released from police custody on Friday.
