Victim's family files lawsuit over deadly gas leak at Deer Park refinery

DEER PARK, Texas – A joint lawsuit has been filed on behalf of the family of Jose Wilfredo Perez Jr., a contractor who died in the deadly Oct. 10 release of hydrogen sulfide at the PEMEX Deer Park refinery.

The incident, which occurred around 4:20 p.m. at the refinery at 5900 Highway 225 in Deer Park, released toxic and flammable gases, including hydrogen sulfide, exposing dozens of workers to serious health risks.

The refinery processes crude oil into various fuels.

According to the lawsuit, the gas leak originated in Units ARU 6 and 7, where it spread to surrounding areas.

Perez, who was stationed in the SR8 unit, was exposed to the dangerous gas, which ultimately led to his death. After the release, a protective order was issued for residents of nearby Deer Park and Pasadena, which also resulted in life-threatening injuries to several other workers.

The lawsuit alleges negligence and gross negligence on the part of the defendants. The reasons cited include deficiencies in safety protocols, inadequate alarms and delays in notifying workers of the release.

“The failure to implement and enforce strict safety protocols resulted in avoidable and devastating losses,” said Houston attorney Benny Agosto Jr. “Jose Wilfredo Perez Jr. was a vibrant young man, just 28 years old, with a bright future ahead of him .” him. Due to this incident, his family has lost a beloved son, husband and family member forever.”

The lawsuit seeks at least $1 million in damages and alleges liability for premises, wrongful death and other grievances. She claims that the defendants permitted the dangerous release without timely warning, thereby endangering numerous people.

This case raises further scrutiny of workplace safety practices, particularly in facilities that process highly toxic substances such as hydrogen sulfide, exposure to which is known to cause serious injury and death.
