Jordan Neely subway death: Testimony continues in Daniel Penny's fatal subway chokehold trial

NEW YORK CITY (WABC) – Testimony continues Monday in the fatal subway strangulation trial of Marine veteran Daniel Penny.

A never-before-seen video was unveiled Friday showing the moments after Jordan Neely's controversial chokehold death in a subway car, as lawyers argue over whether or not the actions taken by Penny were excessive or courageous.

Prosecutors said in opening arguments last week that Penny went too far and lacked human decency toward Neely by holding him in a chokehold for six minutes in May 2023.

However, his defense argued that Penny acted to protect other drivers from a potentially dangerous person.

Police officials testified Friday as jurors were shown new bodycam footage showing the moment officers arrived and asked Penny what happened.

We expect to hear from other subway riders. Some will likely testify that they were afraid of Neely's erratic behavior on the train, while others will likely say there was no reason for the violence to escalate and the eventual death of another passenger.

The trial is expected to last until Thanksgiving.
