BUCKHANNON – A man is behind bars after a fatal two-vehicle crash overnight in Upshur County.

Joshua Barton Foster, 33, was charged with driving under the influence causing death, a felony. He is being held at the Tygart Valley Regional Jail on a $500,000 cash bond.

According to the criminal complaint filed by Corporal A. McCauley of the Buckhannon Police Department, at approximately 2:54 a.m. Saturday, officers were called to Route 33 westbound in front of the Pizza Hut restaurant for a two-vehicle collision on Liggett Addition.

Upon arrival, McCauley was informed by Upshur EMS that an unknown driver was deceased in the second vehicle, the complaint states.

A black Dodge pickup truck was found unoccupied at the scene when officers arrived, the criminal complaint states.

“A witness stated the man ran off behind Pizza Hut.” according to the complaint. From the direction of the restaurant, a man later identified as Foster approached the officer and said he was the driver of the truck.

According to the complaint, Foster blew a .242 on a preliminary breath test, and “Admitted to drinking alcohol before driving.”

If convicted of this charge, Foster faces three to 15 years in prison, a fine of up to $3,000 and the suspension of his driver's license for up to 10 years.
