The suspect in the killing of Chicago police officer Enrique Martinez was arrested at the hearing with many police officers

In a courtroom packed with police officers Thursday, a man was ordered arrested for killing Chicago police officer Enrique Martinez IA traffic stop in Chatham on the South Side resulted in a rapid fire outbreak that also killed the driver of the car.

A relative of Darion McMillian, 23, of Harvey, cried as he was charged with first-degree murder in Monday night's slayings in the 8000 block of South Ingleside Avenue.

McMillian used a handgun equipped with an extended magazine and a switch to automatically fire, police and prosecutors said.

Officers stopped the Ford Escape driven by McMillian around 8 p.m. after noticing it had temporary Wisconsin plates and was parked in the second row, prosecutors said in court.

McMillian was in the passenger seat. As Martinez and his partner spoke with the driver, they noticed McMillian reaching for a backpack at his feet and repeatedly ordering him to stop, officials said.

McMillian pulled out a .40-caliber pistol equipped with a switch and opened fire, hitting both his friend in the driver's seat and Martinez.

McMillian then pushed his friend out of the car, climbed into the driver's seat and drove off while Martinez's partner tried to pull him out of the car.

The Ford Escape crashed into a parked car and McMillian ran into an apartment with a woman inside, officials said. He used a knife to cut off an electronic monitoring bracelet and fled to the 8000 block of South Maryland Avenue, where he was taken into custody.

Suspected shooter has already been charged

McMillian was placed under electronic surveillance in Will County following a recent arrest in Chicago.

The Will County Sheriff's Office issued an arrest warrant for McMillian last month. He was charged with a felony and accused of trying to thwart a drug test, according to court records and Ursitti. At that time, McMillian was charged with cannabis crimes.

According to court documents, Chicago police arrested him on Oct. 11 on a warrant. After he was released on electronic monitoring in the new case, Will County prosecutors asked that he be held pending trial on the cannabis charges. This case continued on October 28th.

McMillian previously pleaded guilty to a felony count of aggravated discharge of a firearm in May 2021, records show.

While in prison in that case, he was charged with additional crimes stemming from a group attack on another inmate.

He pleaded guilty to a battery charge that was downgraded from a felony to a misdemeanor on the same day as his other plea deal.

McMillian was sentenced to four years in prison and mandatory supervised release in the shooting case, records show. In the other case, he was fined and ordered to pay court costs.

When Judge Dyer ordered McMillian's detention, he ordered that the Chicago Police Department and the Civilian Office of Police Accountability not release any records related to the case.
