Ex-St. Xavier employee accused of sexual assault remains out of prison

Court documents show that the former program director at St.

Emily Nutley, 42, pleaded not guilty Wednesday and received her own recognizance bond, meaning she did not have to post any money. The bond was signed by Hamilton County Common Pleas Judge Jennifer Branch.

Officials said Nutley, a married mother of three, was processed at the county jail and released. The prosecutors agreed to their own recognizance guarantee.

Her attorney, Joseph Suhre IV, told The Enquirer on Thursday that his office has asked law enforcement to provide evidence in the case so they can thoroughly review the case.

“We are committed to ensuring that Emily’s case is handled with the utmost fairness, professionalism and efficiency,” Suhre said in an email. “And we will do our best to resolve this matter as quickly as possible.”

Nude photos, texts

The allegations against Nutley date back to the fall of 2023, when, according to prosecutors, she ran a program that helped students at the all-boys Catholic high school who were struggling academically. While working in the program, she met the 17-year-old student and began having additional contact with him outside of school.

That contact included Nutley sending the boy nude photos of himself and sexually explicit messages via text message, prosecutors said.

According to the indictment, Nutley and the student engaged in sexual acts on two days in November 2023. They then had sex in December 2023, the indictment says.

As a condition of the bond, Nutley, who lives in Mason, must have no contact with the student and must not travel outside Hamilton or Warren counties.
