Nintendo sues man who streamed leaked Nintendo Switch games

Nintendo is known to take game piracy very seriously, and another example of this is now the company's lawsuit against a streamer.

At the heart of the case is Jesse Keighin – aka EveryGameGuru – who allegedly streamed pirated and emulated Nintendo Switch games, some of them before release. Things got worse when Keighin continued his actions even after his channels were shut down, informing his audience about pirated games and teasing the company. Nintendo said in its lawsuit: “On October 24, 2024, after certain platforms blocked his unlawful streams due to Nintendo's enforcement actions, he sent Nintendo a letter bragging that he had 'a thousand burner channels' to stream on.” “ [he] 'Can do this all day.'”

Nintendo's lawsuit continues to focus on streaming pirated copies of games before they were publicly released. One example is Mario & Luigi: Brothership, which Keighin played on YouTube and other platforms on October 22nd. Brothership was released just yesterday, November 7th.

The suit States (via 404 media):

“Over the past two years, defendant has streamed gameplay footage of pirated copies of at least ten different Nintendo games without authorization at least fifty times – all before those titles were made available to the public. All of these streams were unauthorized and all jeopardized Nintendo's legitimate pre-release marketing. They also encourage downloading pirated copies of unreleased games. The defendant’s streams often just consist of him playing the leaked Nintendo games for long periods of time without comment.”

Keighin could lose $7.5 million as Nintendo charges $150,000 for each copyright infringement. As mentioned above, Keighin has streamed pirated gameplay footage “at least fifty times in the last two years.”
