MANCHESTER, England (AP) — Manchester City must pay former player Benjamin Mendy most of his 11 million pound ($14.15 million) claim for back wages withheld after he was charged with sexual offenses, a judge ruled on Wednesday.

Mendy sued Premier League champions City at a two-day employment tribunal in Manchester, claiming the club had unfairly cut his salary after he was charged and remanded in custody in August 2021.

After a six-month trial, Mendy was acquitted by a jury of six counts of rape and one count of sexual assault relating to four young women or teenagers. The jury failed to reach a verdict on two counts of rape and attempted rape, leading to a retrial in which he was found not guilty.

Mendy had denied the allegations and said the incidents were consensual encounters.

Court judge Joanne Dunlop ruled City were entitled to retain Mendy's money when he was remanded in custody for breaching bail conditions.

But she said there was nothing in Mendy's contract that allowed City to withhold his wages if the English Football Association suspended him and/or prevented him from playing because of bail.

During the periods when Mendy was not in custody, he was unable to play mainly because he was banned by the FA. The judge ruled that the suspension was “precautionary in nature” and that the governing body had made no findings of misconduct.

The judge concluded that the suspension was an obstacle to the performance of his training and playing contract for City, which was “involuntary” or “unavoidable” for Mendy. She said Mendy's bail conditions were at least indirectly affected by the FA suspension and itself constituted an involuntary or unavoidable obstacle.

The judge said that the club was therefore not entitled to withhold his salary in these cases.

The total amount to which Mendy is entitled has yet to be agreed between his lawyers and the city.

Former France international Mendy joined City from Monaco in 2017 but suffered a knee ligament injury in just his fourth game for the club, which kept him out for most of the season.

He played 75 games for the club. His last was against Tottenham in August 2021.

Mendy now plays for French club Lorient.
