Jody Ann Arcuri was released from prison less than a year ago for an accident that killed a skateboarder in South Daytona. This month she was accused of violating probation by testing positive for meth.

A woman who had drugs and alcohol in her system when the car she was driving struck and killed a skateboarder a decade ago was back in prison, accused of violating her probation by testing positive for methamphetamine was tested.

Jody Ann Arcuri, 42, was released from prison less than a year ago and listed a residence in Astor. But on Friday she was back behind bars at the Volusia County Branch Jail, where she was being held without bail for a probation violation.

Arcuri was driving a car north in the 1700 block of South Ridgewood Avenue in South Daytona around 3:30 p.m. on Feb. 3, 2014, when police said her vehicle skidded and hit Wilson, who was riding his skateboard .

Arcuri's blood alcohol content was 0.092, just above the 0.08 level at which a person is considered unfit to drive. Arcuri also had cocaine, diazepam, a sedative and other drugs in her system. Prosecutors said the blood sample was taken four hours after the crash.

Arcuri reached a plea agreement and was sentenced to 11 years in prison followed by probation in 2015. She pleaded no contest and was found guilty of involuntary manslaughter under the influence of alcohol and six counts of drug possession, including cocaine and marijuana. Her driver's license was permanently revoked.

Wilson's widow, who lived in New Smyrna Beach, said at the sentencing that Arcuri had shown no remorse.

At the hearing, Arcuri said she had “great remorse.” She said she is also a wife and mother of a daughter.

According to the Department of Corrections website, Arcuri was released from prison on December 22, 2023. She was then supposed to serve a four-year suspended sentence for drug offenses.

But on Oct. 4, 2024, a random urine sample test from Arcuri returned a positive result for the presence of methamphetamine, according to a probation violation affidavit. The test was confirmed on October 13, 2024, the affidavit states.

In the years leading up to the fatal accident, Arcuri racked up several traffic citations, including speeding and other violations.

In 2006, Arcuri was charged with possession of crack cocaine. She pleaded no contest and served 60 days in jail.

Arcuri is scheduled to be arraigned Nov. 19 on the probation violation charge.
