The charges were dropped after the incident at Sam's Club in El Paso was captured on video

Charges have been dropped against the man who was caught on video allegedly hitting an 18-year-old after a traffic accident at Sam's gas station in northeast El Paso.

William Jesse Sullivan was arrested and charged with assault on April 16 after a video went viral showing Sullivan punching and head-butting an 18-year-old after he allegedly became impatient at the gas station.

However, according to court records, those charges have since been dropped thanks to a diversion program Sullivan completed before the trial.

This program is often an option for first-time offenders.

The incident occurred on April 6, as KFOX14/CBS4 previously reported, and went viral due to a video that appeared to show the altercation.

In the video, Sullivan appears to punch and headbutt a young man who was behind the wheel of a vehicle. It also shows other drivers getting out of their vehicles and trying to help, and a woman can even be heard screaming in Spanish: “He's a child, you understand?” referring to the victim's youthful appearance.

KFOX14 spoke exclusively with the victim and his mother, who filed charges against Sullivan.

The 18-year-old victim said he was trying to get to the diesel pumps through the crowded gas station when he got stuck. He was unable to get out of the way and said Sullivan, who was driving behind him, became angry and belligerent.

“He just told me to go through and he yelled at me and swore at me. He kept asking me to move but I said I can’t move,” the victim said.

Sullivan then allegedly became so impatient that he reportedly exited his vehicle and approached the victim.

“He goes to my window and punches me through the window right in the nose,” the victim said.

The 18-year-old victim's mother then decided to record what was happening and pulled out her cell phone to record it.

Although the victim suffered visible bruises on his face, he is glad things did not escalate.

“You're scared because it's like he's carrying a knife and I don't know what his intentions are,” he said.

Both the victim and the then-mother hoped that Sullivan would be taken off the streets as they feared he would do it to someone else again, arguing: “He walked up to me and hit me without hesitation, which gave me a hard time.” somehow makes it feel like it's him.” He's done it before, he'd do it again.

“That's kind of cowardly of him, he should have chosen a grown man,” said the mother.

The mother also thanked bystanders who tried to help, saying, “God knows what that man would have done if they hadn't intervened.”

KFOX14/CBS4 also spoke with Sergeant Robert Gomez of the El Paso Police Department, who said this violent incident should never have happened in the first place.

“There really is no excuse for this kind of behavior. “There are a variety of crimes that are committed on the road because drivers sometimes make very simple and harmless mistakes,” Gomez said.

Gomez also said that while there is no charge of “road rage” per se, offenders could face other charges.

“The crimes that result from such incidents range from murder to simple assault,” Gomez said.

The age of the people involved can also play a role in the punishment.

“Depending on the age of the victim, there may be additional charges, not just younger, but older can change the severity of the crime,” Gomez said.

KFOX14/CBS4 also reached out to Sam's corporate office to find out what else could be done to help employees reroute traffic during rush hours.
